RE: The tariff classification of a tube hair wrap and rope bracelet from China and a hair band from Taiwan

Dear Mr. Rider:

In your letter dated September 11, 1997, received in my office on October 21, 1997, you requested a classification ruling. We apologize for the delay in our response. Samples were submitted for examination and will be returned as requested.

Part number RDHW-01, a tube hair wrap, is stated to be made in China and consist of a 100% nylon tube, approximately one inch in diameter closed by a 100% polyester ribbon. Inside of the tube is an elastic band with artificial flowers attached that are stated to be made of 100% PVC plastic with 100% polyester petals. The nylon tube, which imparts the essential character to the item, is considered to made from fabric.

Part number RLHB-01, a hair band, is stated to be made in Taiwan and consist of ABS plastic, wrapped by a 50/50 polyester and nylon cord. The hair band is considered to be of a rigid or semi-rigid construction, covered with textile.

Part number RCBR-01, a rope bracelet, is stated to be made in China and consist of 100% cotton rope. You also request the classification if the rope bracelet was made from nylon. The rope bracelet is considered to be made from fabric.

The applicable subheading for Part number RDHW-01 will be 6217.10.8500, Harmonized Tariff Schedule of the United States (HTS), which provides for "Other made up clothing accessories; parts of garments or of clothing accessories, other than those of heading 6212: Accessories: Other: Headbands, ponytail holders and similar articles." The duty rate will be 15.2 percent ad valorem

The applicable subheading for Part number RLHB-01 will be 9615.19.6000, HTS, which provides for "Combs, hair-slides and the like; hairpins curling pins, curling grips, hair-curlers and the like, other than those of heading 8516, and parts thereof". The duty rate will be 11 percent ad valorem.

The applicable subheading or Part number RCBR-01 will be, 6217.10.9510, HTS, if made of cotton and 6217.10.9530, HTS, if made from nylon, which provides for "Other made up clothing accessories; parts of garments or of clothing accessories, other than those of heading 6212: Accessories: Other". The duty rate will be 15.2 percent ad valorem.

Part number RCBR-01 falls within textile category designation 359 if of cotton and 659 if of nylon. Based upon international textile trade agreements products of China and Taiwan are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
