RE: AC, Single Phase, Non-synchronous, Non-universal Electric Motors

Dear Mr Reynolds:

In your letter dated October 14, 1997 you requested a tariff classification ruling on behalf of National Refrigeration & Air Conditioning Products, Inc.

Your letter requests the tariff classification of three groups of motors. All of the motors are A.C., single-phase, non-synchronous and non-universal. None of the motors are gear motors. The N5xxx series of motors part number(s) N5111, 5211, 5221, 5222, 5311, 5312, 5411, 5412, 5421, 5422, 5811, 5812, 5821, 5822 have an have output from 2.5 to 16 watts. The NRP254/256 motors have an output of 35 watts. The NRP258/260 motors have an output of 50 watts.

The applicable tariff item for the N5xxx series of motors will be 8501.10.4020, Harmonized Tariff Schedule of the United States (HTS), which provides for other electric motors, of an output not exceeding 37.5 watts: Of under 18.65 watts: Other than synchronous, A.C. The rate of duty will be 5.3 per cent ad valorem.

The applicable tariff item for the NRP254/256 motors will be 8501.10.6020, which provides for A.C. electric motors, of an output of 18.65 watts but not exceeding 37.5 watts. The rate of duty will be 3.4 per cent ad valorem.

The applicable tariff item for the NRP258/260 motors will be 8501.40.2040, which provides for other A.C. electric motors, single phase, other than gear motors, of an output exceeding 37.5 watts but not exceeding 74.6 watts. The rate of duty will be 3.7 per cent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
