RE: The tariff classification of toiletry bags from China.

Dear Mr. Ralston:

In your letter dated September 22, 1997, on behalf of Knowlton Cosmetic International, you requested a tariff classification ruling for toiletry bags.

The samples submitted, identified as style numbers VBAGXX1, VBAGXX3, VBAGXX4, VBAGXX5 and VBAG021, are travel bags manufactured of clear Polyvinyl Chloride (PVC) plastic sheeting designed to contain personal effects such as toiletries. Each bag is clearly suited for repetitive use. They will not be discarded upon purchase of the goods. The articles are not considered ordinary packing. Their size range from approximately 8" x 9" to 6" x 5 1/2". The bags are secured by means of either a drawstring and/or flap closure. Your samples are being returned as you requested.

The applicable subheading for the toiletry bag of PVC plastic sheeting will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports and similar bags, with outer surface of sheeting of plastic or of textile materials, other. The rate of duty will be 20 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
