RE: The tariff classification of collector chain and attachments from Japan

Dear Ms. Jones:

In your letter dated September 26, 1997 you requested a tariff classification ruling on behalf of Hitachi Maxco Ltd.

The items you plan to import are collector chain and attachments. Type SAV715 collector chain is constructed of alternating pin links and bushed links. A bush link is described as two bushings pressed into two bushed link plates. You state that there is no free turning roller on the bushing nor anywhere else on the chain. The chain has a pitch of 152.4 mm and contains an average 5 parts per pitch. This chain, including cotter pins, is comprised entirely of stainless steel and has no welded components. From the documentation submitted, the F228 attachments appear to be L-shaped plates which replace the pin link plates. They are imported together with the chain, but are not attached at time of entry.

The applicable subheading for the collector chain will be 7315.12.0080, Harmonized Tariff Schedule of the United States (HTS), which provides for chain and parts thereof, of iron or steel, articulated link chain and parts thereof, other chain, other, other. The rate of duty will be 1.7 percent ad valorem.

The applicable subheading for the attachments will be 7315.19.0000, Harmonized Tariff Schedule (HTS), which provides for chain and parts thereof, of iron or steel, articulated link chain and parts thereof, parts. The rate of duty will be 1.7 percent ad valorem.

Roller chain, other than bicycle chain, from Japan is subject to antidumping case number A 588-028. In order to determine whether or not the subject merchandise is covered by the scope of this investigation you will need to get a ruling from the Department of Commerce. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
