RE: The tariff classification of a spider on a web from China.

Dear Ms. O'Beirn:

In your letter dated September 22, 1997, you requested a tariff classification ruling.

You are requesting the tariff classification of an inflatable spider on a web, item number BW60. The item, which will be used at Halloween, is composed of 70% nylon, 20% PVC, and 10% other materials. The product is a representation of a spider on a web with an inflatable insert and lights included. Since this item is designed primarily for the amusement of children or adults, it is considered a toy, classifiable in heading 9503 of the tariff.

The applicable subheading for the spider on a web will be 9503.49.0025, Harmonized Tariff Schedule of the United States (HTS), which provides for "Toys representing animals or non-human creatures...and parts and accessories thereof: Other...Toys." The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
