RE: The tariff classification of a long line brassiere from Hong Kong.

Dear Ms. Knipper:

In your letter dated September 12, 1997 you requested a classification ruling on behalf of Magaschoni Inc.

The submitted sample, style A610023, is a long line brassiere made of a 88% nylon 12% spandex raschel knit fabric with lace-like construction. The brassiere features adjustable shoulder straps, form fitted underwire cups, four vertical stays approximately four inches in length, and seven panel construction with a hemmed bottom.

The applicable subheading for style A610023 will be 6212.10.9020, Harmonized Tariff Schedule of the United States (HTS), which provides for Brassieres, girdles, corsets, braces, suspenders, garters and similar articles and parts thereof, whether or not knitted or crocheted: brassiere: other: other . . . of man-made fibers. The duty rate will be 17.7 percent ad valorem.

Style A610023 falls within textile category designation 649. Based upon international textile trade agreements products of Hong Kong are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
