RE: The tariff classification of women's knit vests from Taiwan

Dear Mr.Plenby:

In your letter dated August 19, 1997 you requested a tariff classification ruling. Three samples were submitted with your request, however you indicate that you wish only two of the samples be covered by this ruling. Styles a1130 and ea1604 will be addressed in this ruling.

Style a1130 is a women's vest constructed from 60% cotton, 40% polyester finely knit fabric. The vest features a full front right over left buttoned opening, patch pockets below the waist, a drawstring at the bottom and an attached hood. The armholes are deeply cut.

Style ea1604 is a women's vest constructed from 65% polyester, 35% cotton finely knit fabric. The vest features a full front zippered opening, patch pockets at the waist, a shirt collar and deeply cut armholes.

The applicable subheading for Style a1130 will be 6110.20.2035, Harmonized Tariff Schedule of the United States (HTS), which provides for Sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: Of cotton: Other: Vests, other than sweater vests: Women's or girls'. The rate of duty will be 19.4%.

The applicable subheading for Style ea1604 will be 6110.30.3035, Harmonized Tariff Schedule of the U.S. (HTS), which provides for Sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: Of man-made fibers: Other: Vests, other than sweater vests: Women's or girls'. The duty rate will be 33.5%.

Style a1130 falls within textile category designation 359 and Style ea1604 falls within textile category designation 659. Based upon international textile trade agreements, products of Taiwan are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
