RE: The tariff classification of a knit jacket from Indonesia on behalf of Tommy Hilfiger U.S.A., Inc.

Dear Mr. Evan:

In your letter dated August 27, 1997 you requested a tariff classification ruling on behalf of Tommy Hilfiger U.S.A., Inc.

The submitted sample, style 0501247, is an infant's jacket constructed of 100 percent polyester fleece fabric with a collar and overlay of 100 percent woven nylon fabric on the upper chest, shoulders, and upper arms. The garment has a full frontal opening with heavy duty plastic zipper closure, slanted zippered pockets below the waist, an appliqued logo on the left chest, a locker loop below the back collar, long sleeves with rib knit cuffs, and a hemmed bottom. Style 0501247 will be imported in infants' sizes 3/6,6/12,12/18, and 18/24 months and as style 0501243 in boys' 2 to 4T sizes.

The applicable subheading for the jacket in infants' sizes will be, 6111.30.5040 Harmonized Tariff Schedule of the United States (HTS), which provides for babies garments and clothing accessories, knitted or crocheted, of synthetic fibers, other, other. The rate of duty will be 16.7 percent ad valorem.

The applicable subheading for the jacket in boys' sizes will be, 6101.30.3020 Harmonized Tariff Schedule of the United States (HTS), which provides for men's or boys' overcoats...anoraks,...windbreakers, and similar articles, knitted or crocheted,...of man-made fibers, other, boys'. The rate of duty will be 29.5 percent ad valorem.

As requested, your sample will be returned.

The jacket in infants' sizes falls within textile category designation 239. The jacket in boys' sizes falls within textile category designation 239. Based upon international textile trade agreements, products of Indonesia are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
