RE: The tariff classification of a vanity case and a travel bag with outer surfaces of cotton fabric from Taiwan, a vanity case with outer surface of cotton fabric from Sri Lanka, and a travel bag with outer surface of ramie fabric from Taiwan

Dear Ms. Locke:

In your letter dated July 22, 1997 you requested a tariff classification ruling.

The items which Wholesale Supply Company intends to import are a "tapestry" vanity case (item 20818LPRN) and a "tapestry" travel bag (item 20819LPRN) with outer surfaces of woven fabric which is 55 percent cotton and 45 percent jute by weight from Taiwan, a travel bag (item 21115LPRN) with an outer surface of a woven fabric which is 55 percent ramie and 45 percent polyester by weight from Taiwan, and a vanity case (item 4801385BDC) which is 60 percent cotton and 40 percent polyester by weight from Sri Lanka. The two vanity cases have zip around closures, interior mirrors and zippered pockets, single carry handles and detachable, adjustable shoulder straps, and straps to hold bottles or brushes in place inside the bags. Item 20818LPRN also has open top interior pockets, and item 4801385BDC has open top exterior pockets at both ends of the bag. The travel bags have zippered closures, zippered interior and exterior pockets, and double carry handles. Item 20819LPRN has a textile webbing detachable, adjustable shoulder strap and two open top interior pockets. Item 21115LPRN has two detachable, adjustable straps which would allow the item to be used as a backpack.

The applicable subheading for the vanity cases of cotton fabric will be 4202.12.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for trunks, suitcases, vanity cases, ... and similar containers, with outer surface of textile materials, of vegetable fibers and not of pile or tufted construction, of cotton. The rate of duty will be 6.9 percent ad valorem. The applicable subheading for the travel bag of cotton fabric will be 4202.92.1500, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports and similar bags, with outer surface of textile materials, of vegetable fibers and not of pile or tufted construction, of cotton. The rate of duty for this item will also be 6.9 percent ad valorem. The applicable subheading for the travel bag of ramie fabric will be 4202.92.2000, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports and similar bags, with outer surface of textile materials, of vegetable fibers and not of pile or tufted construction, other. The duty rate for this item will be 6.3 percent ad valorem.

Items 4202.12.4000 and 4202.92.1500 fall within textile category designation 369. Item 4202.92.2000 falls within textile category designation 870. Based upon international textile trade agreements, products of Sri Lanka and Taiwan are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). The samples are being returned herewith in accordance with your request.

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
