RE: The tariff classification of hot water heaters from Mexico

Dear Mr. Noell:

In your letter dated February 24, 1997, on behalf of In-Sink-Erator, a division of Emerson Electric, you requested a tariff classification ruling.

The merchandise is the model H770 In-Sink-Erator Hot Water Dispenser. The system consists of a 1/2-gallon hot water storage tank connected to a chrome plated faucet. The dispenser is mounted onto the kitchen sink and delivers 1900 water on demand. Your request involves the entire item and the tank and valve assemblies imported separately.

The applicable tariff provision for the In-Sink-Erator Hot Water Dispenser will be 8516.10.0040, Harmonized Tariff Schedule of the United States Annotated (HTSUSA), which provides for electric instantaneous or storage water heaters and immersion heaters, storage water heaters. The general rate of duty will be 1.5 percent ad valorem.

The applicable tariff provision for the tank assembly will be 8516.90.0500, Harmonized Tariff Schedule of the United States Annotated (HTSUSA), which provides for parts of heaters or heating apparatus of subheading 8516.10 [electric instantaneous or storage water heaters and immersion heaters]. The general rate of duty will be 3.7 percent ad valorem.

The applicable tariff provision for the valve assembly will be 8481.80.1030, Harmonized Tariff Schedule of the United States Annotated (HTSUSA), which provides for taps, cocks, valves and similar appliances ... other appliances, hand operated, of copper. The general rate of duty will be 4.6 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 CFR 177).
