RE: The tariff classification of 1-Chloronaphthalene (CAS 90-13-1), Triphosgene (CAS 32315-10-9) and 5-Bromoisatoic Anhydride (CAS 4692-98-2) from China.

Dear Ms. Qiu:

In your letter dated February 18, 1997, you requested a tariff classification ruling for the above products.

The applicable subheading for 1-Chloronaphthalene, which is used as a chemical intermediate, will be 2903.69.7000, Harmonized Tariff Schedule of the United States (HTS), which provides for halogenated derivatives of hydrocarbons: halogenated derivatives of aromatic hydrocarbons: other. The rate of duty will be 6.9 percent ad valorem.

The applicable subheading for Triphosgene (Chemical Name - Bis (Trichloromethyl) Carbonic Acid Ester), which is used as a lachrymator (tear producing agent), will be 2920.90.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for esters of other inorganic acids (excluding esters of hydrogen halides) and their salts; their halogenated, sulfonated, nitrated or nitrosated derivatives: other. The rate of duty will be 3.7 percent ad valorem.

The applicable subheading for 5-Bromoisatoic Anhydride (Chemical Name - 6-Bromo-2H-3,1-Benzoxazine-2,4(1H)-Dione), which is used as a photographic tone controlling agent, will be 2934.90.2000, Harmonized Tariff Schedule of the United States (HTS), which provides for nucleic acids and their salts; other heterocyclic compounds: other. The rate of duty will be 7.3 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
