RE: The tariff classification of a shaving kit bag and briefcase from Mexico.

Dear Mr. Caballero:

In your letter dated August 11, 1993, you requested a tariff classification ruling on behalf of your client, NSC Corporation.

You have submitted two samples with your request. Model 311 is a shaving kit bag and Model 1640 is a briefcase/portfolio. Both items are unlined and have exterior surfaces of 100% polyester.

Model 311 is approximately 11 1/2" x 8" x 3". It features a full zipper closure and a self material handle. Model 1640 is approximately 15 1/2" x 11". It features a full zipper closure, at the top, and two self material handles.

You state in your letter that both items will be assembled in Mexico from U.S. components. You are not requesting advice as to the applicability of 9802, but rather you only wish to ascertain the respective HTSUSA numbers and visa/quota requirements.

The applicable subheading for Model 1640 will be 4202.12.8030, Harmonized Tariff Schedule of the United States (HTS), which provides for attache cases, brief cases, school satchels, occupational luggage cases and similar containers, with outer surface of textile materials, other, of man-made fibers. The rate of duty will be 20% ad valorem.

The applicable subheading for Model 311 will be 4202.92.3030, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports and similar bags, with outer surface of textile materials, other, of man-made fibers, other. The rate of duty will be 20% ad valorem.

Models 311 and 1640 fall within textile category designation 670. Based upon international textile trade agreements, products of Mexico are subject to visa requirements and quota restraints.

The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report On Current Import Quotas (Restraints Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
