RE: The tariff classification of an audio carrying case from Taiwan.

Dear Mr. Newman:

In your letter dated June 29, 1993, on behalf of California Innovations, Inc., you requested a tariff classification ruling for an audio carrying case.

You have submitted a sample of an item you described as an "Audio Console", which is an audio carrying case composed of an exterior surface of vinyl. Although the case can be used in a motor vehicle, it can also be used during travel to contain personal effects. The interior is padded and contains two divided compartments. There is a front exterior full- width zippered storage pocket. The case measures approximately 9" x 8" x 5 3/4". It is secured by means of a textile zippered closure around the entire top circumference of the case. The item is carried by means of a webbed textile handle permanently affixed to one side of the case.

The applicable subheading for the audio carrying case of vinyl will be 4202.92.9040, Harmonized Tariff Schedule of the United States (HTS), which provides for trunks, suitcases, camera cases and similar containers, with outer surface of plastic sheeting, other, other, other. The duty rate will be 20 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
