RE: The tariff classification of NH 503P, R-778-P, and 2K Flex (Basecoat Paint) from Canada.

Dear Ms. Haupt:

In your letter dated May 28, 1993, on behalf of your client DuPont Canada Inc., you requested a tariff classification ruling on the following three basecoat paint:

Product HTS Duty

NH 503P Basecoat Paint 3208.20.0000 3.7% ad valoerm R-778-P Basecoat Paint 3208.20.0000 3.7% ad valoerm 2K Flex Basecoat Paint 3208.20.0000 3.7% ad valoerm

These basecoat paints consists of an acrylic polymer, solvents, pigment and various additives. It is used in the automotives industry as a coating for professional application to metal and other substrates.

Articles classifiable under subheading 3208.20.0000, HTS, which are products of Canada are entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
