RE: The tariff classification of a Kit containing a book, belts and a video tape from Canada.

Dear Mr. Baker:

In your letter dated May 5, 1993, on behalf of your client Productions StonHaven Inc., you requested a tariff classification ruling.

The imported unit is described as a kit. The kit contains the following items:

1. Teaching guidedbook - including binder and forms.

2. Transfer belts - used by nurses to assist in lifting patients. (100 percent nylon)

3. Teaching video - A video which contains the method of properly lifting patients with the belt.

The applicable subheading for the teaching guidedbook in a binder with forms will be 4901.99.0050, Harmonized Tariff Schedule of the United States (HTS), which provides for technical, scientific, and professional books. The rate of duty will be free.

The applicable subheading for the transfer belts will be 6307.90.9986, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles including dress patterns: Other: Other: Other: Other Other,. The duty rate will be 7 percent ad valorem.

The applicable subheading for the teaching video will be 8524.23.1040, Harmonized Tariff Schedule of the United States (HTS), which provides for video tape readings. The duty rate will be 9.7 cents per square meter of recording surface.

Goods classifiable under subheading 6307.90.9986, HTS, which have originated in the territory of Canada, will be entitled to a 3.5 percent ad valorem rate of duty under the United States-Canada Free Trade Agreement (FTA) upon compliance with all applicable regulations.

Goods classifiable under subheading 8524.23.1040, HTS, which have originated in the territory of Canada, will be entitled to a 4.8 cents per square meter of recording surface rate of duty under the United States-Canada Free Trade Agreement (FTA) upon compliance with all applicable regulations.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
