RE: The tariff classification of a musical mug from China.

Dear Mrs. Spurgeon:

In your letter dated March 4, 1993, on behalf of your client, The Coltrane Company, you requested a tariff classification ruling.

The sample submitted is a musical ceramic mug, known as a "melody mug", which measures about 4 inches in height by 3 inches in diameter. It contains an electronic chip, at its bottom portion, which activates the musical melody of "Love Me Tender" when the mug is picked up.

The applicable subheading for the musical ceramic mug will be 6912.00.4400, Harmonized Tariff Schedule of the United States (HTS), which provides for ceramic mugs, other than of porcelain or china. The rate of duty will be 13.5 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
