RE: The tariff classification of a child's hooded towel and wash cloth from Hong Kong.

Dear Ms. Rodriquez:

In a letter dated September 7, 1990, on behalf of Michael Friedman Corp., you requested a tariff classification ruling.

You submitted two samples, a child's hooded terry towel and a wash cloth made of 100 percent cotton terry fabric. The child's hooded terry towel measures approximately 29 1/2 inches square. The edges are finished with a blue wrap trim; one corner of the towel has a triangular piece of the same fabric attached to it forming a pocket effect. This pocket is used as a hood to cover the child's head after a bath, while the remainder of the towel is used to dry off or cover the infant. The hood is decorated with an applique design. The wash cloth measures approximately 11 15/16 inches square and the edges are finished with blue stitching. The wash cloth has the same applique design found on the towel. The samples are being returned.

The applicable subheading for the child's hooded towel will be 6302.60.0020, Harmonized Tariff Schedule of the United States (HTS), which provides for toilet linen and kitchen linen, of terry toweling or similar terry fabrics, of cotton...towels: other. The rate of duty will be 10.3 percent ad valorem.

The applicable subheading for the wash cloth will be 6302.60.0030, HTS, which provides for toilet linen and kitchen linen, of terry toweling or similar terry fabrics of cotton... towels: other. The rate of duty will be 10.3 percent ad valorem. The child's hooded towel falls within textile category designation 363. The wash cloth falls within textile category designation 369. Based upon international textile trade agreements, products of Hong Kong are subject to export license requirements.

The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
