RE: The tariff classification of aluminum conductors from Venezuela.

Dear Mr. Lima:

This classification decision under the Harmonized Tariff Schedule of the United States (HTS) is being issued in accordance with the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

DATE OF INQUIRY : August 14, 1990

DESCRIPTION OF
MERCHANDISE : The descriptive literature indicates that the following electrical conductors are to be imported:

1. Electric aluminum conductors manufactured according to ASTM standards and specifications, of aluminum wires or aluminum alloy wires in coil shape or on reels, to be used on overhead transmission and primary or secondary distri- bution lines;

2. Electric aluminum conductors manufactured according to ASTM standards and specifications, of aluminum wires with a solid or stranded steel core in coil shape or on reels, to be used as bare overhead transmission cable and as primary or secondary distribution cable;

3. Covered line wire of aluminum with a plastic covering manufactured according to ASTM and ICEA standards and specifications in coil shape or on reels, to be used primarily for secondary distribution lines;

4. Multiplex overhead aluminum cables manufactured of 1, 2, or 3 insulated cables around one neutral messenger made of either aluminum, aluminum alloy or ACSR conductor, to be used at voltages of 600 V or less to supply 3-phase power.

HTS PROVISION : Stranded wire, of aluminum, not electrically insulated: Other: for item 1.

HTS SUBHEADING : 7614.90.2000

RATE OF DUTY : 4.9 percent ad valorem.

HTS PROVISION : Insulated electrical conductors, whether or not fitted with connectors: Other electric conductors, for a voltage exceeding 80 V but not exceeding 1,000 V: Other: Other... for items 3 and 4.

HTS SUBHEADING : 8544.59.4000

RATE OF DUTY : 4.9 percent ad valorem.

DUTY CONCESSION : Articles classifiable under subheading 7614.90.2000 and 8544.59.4000, HTS, which are products of Venezuela, are entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations.

Your inquiry does not provide enough information to give a classification ruling on item 2. Your request for a classification ruling should include the separate weights of the steel portion and the aluminum portion, a description of the strand construction and copies of any standards or specifications to which the product is made to conform.

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
