RE: The tariff classification of toilet water and soap from France.

Dear Ms. Arraki:

In your letter dated January 23, 1990, you requested a tariff classification ruling.

The prospective imports consist of three differently packaged samples of toilet water in glass bottles and soap in bar form. They are packaged in a poly-satin drawstring bag, a clear vinyl drawstring bag and a plastic display unit with both items in cardboard boxes. Samples were received of the items packaged in drawstring bags with precut foam for holding the soap. The items are separately classifiable under the following applicable subheadings:

ITEM HTS DUTY

Soap in bar form 3401.11.5000 1.1 cent per kg plus 3.6 percent ad valorem

Toilet water with 3303.00.3000 5 percent ad valorem with alcohol

Poly-satin 4202.92.3030 20 percent ad valorem drawstring bag
(travel bags with outer surface of man-made fibers)

Clear vinyl 4202.92.4500 20 percent ad valorem drawstring bag
(travel bags with outer surface of plastic sheeting)

The foam, plastic display unit and cardboard boxes are merely packing for the items.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
