RE: The tariff classification of "Tilt 'n' Slide" from Canada.

Dear Ms. Carr:

In your letter dated October 30, 1989, on behalf of Preferred Engineering Products, Ltd., you requested a tariff classification ruling.

A sample, that will be returned to you as requested, and a descriptive brochure accompanied your letter. The "Tilt 'n' Slide" is a window hardware fitting consisting of plastic and metal components. The metal components are galvanized steel and brass rollers. The steel portion of the article is considered the component material that gives the article its essential character. This device, when installed, facilitates the opening, cleaning, and emergency removal of windows.

The applicable subheading for the "Tilt 'n' Slide" will be 8302.41.6045, Harmonized Tariff Schedule of the United States (HTS), which provides for other base metal mountings and fittings suitable for windows. The duty rate will be 5.7 percent ad valorem.

Goods classifiable under subheading 8302.41.6045, HTS, which have originated in the territory of Canada, will be entitled to a 5.1 percent rate of duty under the United States-Canada Free Trade Agreement (FTA) upon compliance with all applicable regulations.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
