RE: The tariff classification of a girl's knit dress costume from West Germany.

Dear Ms. Jackson:

In your letter dated October 3, 1989, on behalf of Klein International Ltd., you requested a tariff classification ruling.

You have submitted a sample of a French maid's outfit, article no. 4304, intended primarily for use as a Halloween costume. The outfit is a girl's dress made of 100% polyester knit fabric, 100% polyester raschel knit lace trim, and a red fabric rose sewn onto the apron portion of the dress.

The applicable subheading for the knit dress will be 6104.43.2020, Harmonized Tariff Schedule of the United States (HTS), which provides for women's or girls' suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear); knitted or crocheted, dresses, of synthetic fibers, other, girls'. The rate of duty will be 17 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
