RE: The tariff classification of nonwoven disposable wipes (in container/serving trays) for use on airlines, from the United Kingdom.

Dear Mr. Suri:

In your letter dated August 20, 1997, on behalf of Avid Airlines Products of RI, you requested a tariff classification ruling. The manufacturer is Allen Amery Textile Importers, West Midlands, United Kingdom.

The instant samples consist of nonwoven wiping towels measuring about 8" x 8" square. These towels are composed of a blend of 50% polypropylene/50% viscose rayon man-made fibers, by weight, which appear to be staple fibers. These towels are imported in a flimsy plastic tray (40 to a tray), as illustrated by the instant sample, and contain an inexpensive plastic serving tong which is disposable. These towels were informally weighed and were found to weigh approximately 68.76 grams per square meter.

The applicable subheading for the product (including the tray and tong which are considered packing), will be 5603.92.0090, Harmonized Tariff Schedule of the United States (HTS), which provides for nonwovens, whether or not impregnated, coated, covered or laminated, of other than filaments, weighing more than 25g/m2 but not more than 70g/m2. The rate of duty will be 5 percent ad valorem.

We concur with your contention that this merchandise falls within textile category 223, however, there are no textile restraints for this merchandise, being a product of the United Kingdom.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
