RE: The tariff classification of a toy/candy dispenser from China.

Dear Mr. Keeney:

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

DATE OF INQUIRY : August 15, 1997

DESCRIPTION OF
MERCHANDISE : The article is identified as item #4750, a candy hander. The item to be imported is the plastic M&M's character only, since the candy will be added in the United States. The candy hander is a 4 and 1/2 inch tall plastic toy which represents the whimisical M&M's Candy characters. The item will be used as a candy dispenser, but it's play value is readily apparent.

HTS PROVISION : Toys representing animals or non-human creatures...and parts and accessories thereof: Other...Toys.

HTS SUBHEADING : 9503.49.0025

RATE OF DUTY : Free
