RE: The tariff classification of gloves from the Philippines and Japan.

Dear Mr. Awana:

In your letter dated July 10, 1997, filed on behalf of Pacific 4, you requested a classification ruling.

Three samples of gloves were submitted for review. Style P-1, is a stringknit glove with a ribbed knit cuff. You have indicated that the glove is constructed of a nylon/polyester fabric. The entire palm of the glove from fingertips to wrist has a PVC dot coating. The essential character of the glove is imparted by the coated man-made stringknit fabric palm.

Style P-2 is a stringknit glove constructed of a white nylon fabric with a ribbed knit cuff which is trimmed with contrasting green color tread at the cuff edge. The essential character of the glove is imparted by the man-made stringknit fabric outershell.

Style P-3 is a stringknit glove constructed of a white nylon polyester fabric with a ribbed knit cuff. Style P-3 is identical to Style P-2 with the exception of fabric content and white thread at the cuff. The essential character of the glove is imparted by the knitted man-made stringknit fabric outershell.

The applicable subheading for Style P-1 will be 6116.10.5520, Harmonized Tariff Schedule of the United States (HTS), which provides for Gloves, mittens and mitts, knitted or crocheted: impregnated, coated or covered with plastics or rubber: other: without fourchettes: other: containing 50 percent or more by weight of cotton, man-made fibers or other textile fibers, or any combination thereof . . . subject to man-made fiber restraints. The duty rate will be 13.8 percent ad valorem.

The applicable subheading for styles P-2 and P-3 will be 6116.93.8800, Harmonized Tariff Schedule of the United States (HTS), which provides for Gloves, mittens and mitts, knitted or crocheted: other: of synthetic fibers: other: other: without fourchettes. The duty rate will be 19.4 percent ad valorem.

All styles fall within textile category designation 631. Based upon international textile trade agreements products of the Philippines are subject to quota, and products of both the Philippines and Japan are subject to the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
