RE: The tariff classification of swimwear from China.

Dear Ms. Iacobello:

In your letter dated July 17, 1997, you requested a classification ruling. As requested, the sample will be returned to you.

Your submitted sample, style 4598700, is a pair of men's swimming trunks of nylon woven fabric. The garment features a partially elasticized waistband which is tightend by a drawcord that fastens through six grommets, a fly front secured by a hook and loop closure, contrasting stitching, a polyester mesh liner, an internal coin pocket, a buttoned flapped back pocket and hemmed leg openings.

The applicable subheading for style 4598700 will be 6211.11.1010, Harmonized Tariff Schedule of the United States (HTS), which provides for track suits, ski-suits and swimwear; other garments: swimwear: men's or boys: of man-made fibers, men's. The duty rate will be 29.1 percent ad valorem.

Style 4598700 falls within textile category designation 659. Based upon international textile trade agreements products of China are subject to the requirement of a visa and quota restraints.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
