RE: The tariff classification of a Nativity scene from China.

Dear Ms. Harvey:

In your letter dated July 1, 1997, you requested a tariff classification ruling on a Nativity scene for your client Consolidated Stores Corporation.

The sample consists of a poly resin scene of the Nativity in a village setting next to a pond and a waterfall. There is a battery operated pump and an electric musical movement built into its base. When switched on, water is pumped over the falls into the pond and twelve different Christmas carols are played by the musical movement.

The applicable subheading for the Nativity scene will be 9505.10.3000, Harmonized Tariff Schedule of the United States (HTS), which provides for articles for Christmas festivities and parts and accessories thereof: Nativity scenes and figures thereof. The rate of duty is free.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

Your sample is being returned under separate cover.

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
