RE: The tariff classification of a tent from China.

Dear Ms. Van Den Broeke:

In your letter received by this office June 12, 1997, on behalf of Jinwoong, Inc., you requested a classification ruling.

The sample submitted is an eight person tent which consists of two dome-shaped tents, model number 77122. A tunnel connector made of nylon woven fabric connects the two tents into one 18 feet by 7 feet with the center height measuring 59 inches. The walls are made of woven nylon taffeta fabric. The roof is constructed of the same fabric as the walls. The floor is composed of polyethylene strips which are coated on both sides with plastic. When not in use the tents are housed in woven nylon fabric drawstring bags.

The applicable subheading for the tent will be 6306.22.9030, Harmonized Tariff Schedule of the United States (HTS), which provides for tents: Of synthetic fibers: Other, other. The duty rate will be 9.6 percent ad valorem.

The tent falls within textile category designation 669. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
