RE: The tariff classification of water toys and a rocket set from China

Dear Ms. Chip:

In your letter dated June 6, 1997 you requested a tariff classification ruling. One of the four articles submitted, item #02693 "Sprinkler Snake," will be answered in a separate letter. The "Air Blast Rocket" is identified as item #82406. The product consists of two foam rockets and a launcher unit. The rockets are propelled by a force of air generated by stepping on a launcher pedal. All components will be packaged in a closed box.

Item #02664, "Mega Frog Squirtee," is a soft plastic representation of a frog. The frog is hollow inside to permit ingestion of water when immersed. Upon raising the frog above surface, one may squeeze him, causing water to spurt out from a tiny hole in his mouth.

The "Baby Wading Pool Basketball" set, item #02607, includes an inflatable basketball stand with hoop and an inflatable ball. This article is designed for use in the pool by children aged 9 to 36 months. When inflated, the basketball stand measures approximately 14 inches high and the ball has a diameter of 5 inches wide.

The applicable subheading for the "Air Blast Rocket," item #82406 and "Baby Wading Pool Basketball" set, item #02607, will be 9503.70.0030, Harmonized Tariff Schedule of the United States (HTS), which provides for other toys, put up in sets or outfits, and parts and accessories thereof: other: other. The rate of duty will be free.

The applicable subheading for the "Mega Frog Squirtee," item #02664, will be 9503.49.0020, Harmonized Tariff Schedule of the United States (HTS), which provides for toys representing animals or non-human creatures: other: toys not having a spring mechanism: other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
