RE: The tariff classification of women's shirts from Costa Rica

Dear Ms. Burns:

In your letter dated May 27, 1997, you requested a classification ruling on behalf of Uniforms To You. The samples submitted with your request will be returned to you under separate cover.

Four styles of women's shirts were submitted with your request. The garments button right over left and will be imported in various colors and in sizes S-XL. All of the garments extend to the vicinity of the hips and feature pockets below the waist.

Style 6680-00-27 is a shirt constructed from 80 percent polyester/20 percent cotton woven fabric. The garment is slightly fitted at the waist and features short, cuffed sleeves, a collar with contrasting colored lapels, two patch pockets below the waist and a double breasted full front opening secured by three buttons and a hidden snap.

Style 100-302-011 is a shirt constructed from 75 percent polyester/25 percent cotton woven fabric. The shirt features short sleeves that are cuffed with a contrasting color, a collar with contrasting colored lapels, two patch pockets below the waist and a double breasted full front opening secured by four buttons.

Style 1895-00-11 is a shirt constructed from 89 percent polyester/20 percent cotton woven fabric. The shirt features short sleeves, a contrasting colored collar, lapels, two patch pockets below the waist, a full front opening secured by four buttons. The shirt has a rounded bottom.

Style 1891-00-11 is a shirt constructed from 65 percent polyester/35 percent cotton woven fabric. The shirt features short sleeves with contrasting colored cuffs, a contrasting colored collar, lapels, two patch pockets below the waist and a full front opening secured by six buttons.

The applicable subheading for all of the shirts will be 6211.42.0054, Harmonized Tariff Schedule of the United States (HTS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women's or girls': of cotton: blouses, shirts and shirt-blouses, sleeveless tank styles and similar upper body garments excluded, from heading 6206: with two or more colors in the warp and/or the filling. The duty rate will be 8.4 percent ad valorem.

The shirts fall within textile category designation 341. Based upon international textile trade agreements products of Costa Rica are not currently subject to a visa requirement or quota restraints.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
