RE: The tariff classification of Mesh Easter Wrap and Easter Grass from China

Dear Ms. Berghauser:

In your letter dated May 30, 1997 you requested a tariff classification ruling.

You have submitted two samples of articles as follows:

1) Mesh Easter Wrap, item #610350, is a sheet of polypropylene netting formed through an extrusion process. It measures approximately 30 inches by 54 inches, and is packaged for retail sale as a decorative wrap for Easter baskets.

2) Easter Grass, item #610342, which you indicated in a phone conversation are 100% polypropylene strips that are .2mm wide and 19 mm long. The item is used as ornamental material in baskets, etc. for packing.

The applicable subheading for the polyethylene net Easter basket wrap will be 3920.10.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for other plates, sheets, film, foil and strip, of plastics, noncellular and not reinforced, laminated, supported or similarly combined with other materials, of polymers of ethylene. The rate of duty will be 4.2 percent ad valorem.

The applicable subheading for the Easter Grass will be 5404.90.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for strip and the like...of synthetic textile materials of an apparent width not exceeding 5mm; other. The general rate of duty will be 3.6 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
