RE: The tariff classification of a decorative glass bottle from China and/or Spain

Dear Ms. Johnson:

In your letter dated May 9, 1997, you requested a tariff classification ruling regarding two decorative glass bottles. Representative samples were submitted and will be returned as you requested.

Regarding item B-123, we require additional information in order to issue a classification ruling. You stated that this bottle can be used to hold different materials including spices, cooking oil, perfume, etc. Please provide any available advertising material, photographs and marketing literature showing how the item will be used and marketed. Please indicate the percentage of your customers who will use the article in each way (the percentage who will use it to hold perfume or toilet preparations, the percentage who will use it to hold cooking oil, etc.). When this information is available, you may wish to consider resubmission of your request. If you decide to resubmit your request, please resubmit the sample.

Item A-123 is a small decorative glass bottle with a cork lid measuring approximately five inches in height and one inch in width. You indicated in a telephone conversation that the unit value for this article is under three dollars.

The applicable subheading for the small decorative glass bottle (item A-123) will be 7013.99.5000, HTS, which provides for glassware of a kind used for table, kitchen, toilet, office, indoor decoration or similar purposes...: other glassware: other: other: other: valued over $0.30 but not over $3.00 each. The rate of duty will be 30 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
