RE: The tariff classification of Christmas tree decoration from India.

Dear Ms. Miranda:

In your letter dated April 22, 1997, you requested a tariff classification ruling.

The submitted sample is identified as Bullion Wire. It is made of copper shavings. This product is designed to be used as Christmas tree decorations. It is draped on the Christmas tree in a similar manner that tinsel would be draped on the tree. This item is packaged in a plastic bag with a header card made of cardboard. The Bullion Wire is composed of a non-durable material and it is not intended for sustained wear and tear.

This sample is returned as requested.

The applicable subheading for the Bullion Wire will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for festive...articles for Christmas festivities and parts and accessories thereof: Christmas ornaments: other, other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
