RE: The tariff classification of a wallet and a drawstring pouch from China.

Dear Mr. Taddeo:

In your letter dated May 6, 1997, on behalf of Trafalgar Ltd., you requested a tariff classification ruling for a wallet and a drawstring pouch.

You have submitted two samples with your request, identified as style number HW900-099, which consists of a "Tommy Hilfiger" wallet and a drawstring travel pouch.

The wallet, described as a "zippered wallet" measures approximates 4 1/2" x 5" in its closed position. The wallet is composed of an exterior surface of cellular plastics with a knit fabric backing.

The drawstring travel pouch, described as a "wallet bag", measures approximately 5 1/4"(W) x 6 1/2"(H) designed to contain small personal effects during travel. The pouch is composed of an exterior surface of cellular plastics sheeting material and textile mesh. One fabric is equally as essential as another. Therefore, the material which appears last in the tariff applies. The item is of plastics (GRI-3(c) Noted).

You have requested the proper classification for the items if imported separately or together as a set. Whether imported separately or together the classification will remain the same.

The applicable subheading for the wallet of plastics will be 4202.32.1000, Harmonized Tariff Schedule of the United States (HTS), which provides for articles of a kind normally carried in the pocket or in the handbag, with outer surface of sheeting of plastic or of textile materials, of reinforced or laminated plastics. The rate of duty will be 12.1 cents per kilogram plus 4.6 percent ad valorem.

The applicable subheading for the drawstring travel pouch of plastics will be 4202.92.4500, HTS, which provides for travel, sports and similar bags, with outer surface of sheeting of plastic, other. The rate of duty will be 20 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
