RE: The tariff classification of boys' jackets from Singapore

Dear Mr. Evan:

In your letter dated March 27, 1997 you requested a tariff classification ruling on behalf of Tommy Hilfiger, U.S.A., Inc.

The submitted samples, style 0501202 and style 0501205, are identical jackets in different sizes. The jackets have a quilted shell fabric of 100 percent polyester knit material laminated on the exterior surface with plastic which completely obscures the underlying fabric, polyfill insulation, and a lining of 100 percent nylon woven material. The garments feature a full front opening with heavy duty plastic zipper closure, a storm flap with six snap closure which extends into the stand-up collar, an attached hood which can be stored under the back collar, two front pockets with velcro closure, elasticized cuffs, and a hemmed bottom. Style 0501202 will be imported in infants' sizes 3 to 24 months. Style 0501205 will be imported in boys' sizes 2 to 4T.

The applicable subheading for the jacket, style 0501202 will be 6111.30.5040, Harmonized Tariff Schedule of the United States (HTS), which provides for babies' garments' and clothing accessories, knitted or crocheted, of synthetic fibers, other, other, other. The rate of duty will be 16.7 percent ad valorem.

The applicable subheading for the jacket, style 0501205 will be 6113.00.1005, Harmonized Tariff Schedule of the United States (HTS), which provides for garments made up of knitted or crocheted fabric of heading of 5903,5906, and 5907. The rate of duty will be 6.5 percent ad valorem.

As requested, your samples will be returned.

The jacket, style 0501202 falls within textile category designation 239. The jacket, style 0501205 has no textile category designation. Based upon international textile trade agreements, products of Singapore are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
