RE: The tariff classification of bait boxes from China.

Dear Mr. Berry:

In your letter dated January 9, 1997, on behalf of The Danielson Co., you requested a tariff classification ruling addressing the acceptability of the country of origin marking as it relates to the samples submitted.

You have submitted samples and literature of two items identified as styles Y586 (premier bait box) and M5 (two compartment bait box), which are containers designed to be used in sport fishing similar to tackle fly cases. Both items are constructed of black molded plastic with hinged lids designed to be worn on the belt. The articles are sealed in a poly bag with header. The header is printed "Manufactured in China" for the "Danielson Company" in equal print. If the articles are sold at retail in condition as submitted, the marking is acceptable and within compliance with (19 U.S.C. 1304) and (19 CFR 134.44) Customs Regulations.

The applicable subheading for the Styles Y586 and M5, the bait boxes of molded plastic, will be 4202.99.9000, Harmonized Tariff Schedule of the United States (HTS), which provides in part for other bags and containers, other, other, other. The rate of duty will be 20 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
