RE: The tariff classification of a musical doll from China Dear Ms. Aaront:

In your letter dated October 30, 1996, you requested a tariff classification ruling. A photo of the subject sample was enclosed with your request.

The article is a musical doll known as "Yo-Yo Darlin Doll" and designated as style no. 1500. According to the information provided in your request, the doll has rooted blond hair and stands 16" high. The head and torso are made of molded plastic while the arms and legs are constructed of soft vinyl. The doll has a battery powered musical chip and mechanism located in the back portion of the torso which is controlled by a switch. Activating the switch allows the doll to open and close her eyes, walk, and play a tune. In addition to these movements the doll has a yo-yo on her right hand that goes up and down. The doll wears white plastic shoes and is clothed in a romper outfit. Batteries are not included with the article.

The applicable subheading for the musical doll will be 9502.10.0040, Harmonized Tariff Schedule of the United States (HTS), which provides for dolls representing only human beings and parts and accessories thereof: whether or not dressed: other: other: other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
