RE: The tariff classification of two handbags and one sling tote bag of man-made fiber fabric from Hong Kong or China

Dear Ms. Dairo:

In your letter dated November 11, 1996 you requested a tariff classification ruling.

The items which Federated intends to import are two handbags and one sling tote bag with outer surfaces predominantly of a polypropylene strip fabric in which the polypropylene strips are less than 5 millimeters in apparent width. Style 15430 is a "hobo" style handbag measuring approximately 14 x 3 3/4 x 12 inches and having a top zippered closure, a zippered interior pocket, outer surfaces of its ends, top and bottom of plastic sheeting, and a single carry handle/shoulder strap also of plastic sheeting. Handbag Style 15527 measuring approximately 11 x 5 x 10 inches consists of two adjacent compartments, one having a top magnetic snap closure and the other a top zippered closure. The zippered compartment contains an interior zippered pocket. The bag has a base and top and bottom trim of plastic sheeting and has two carry handles/shoulder straps of the same material. The single sling tote bag (Style 15431) has a circular base measuring approximately 7 inches in diameter and is approximately 17 1/2 inches in height. It has a base and top and bottom trim of plastic sheeting, a single shoulder strap of the same material allowing the bag to be carried slung over the
shoulder, and a zippered closure along one side in addition to a zippered top closure, both of which serve as access to the bag's interior.

The applicable subheading for the two handbags with outer surfaces of polypropylene fabric will be 4202.22.8050, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags, with outer surface of textile materials, other, other, of man-made fibers. The rate of duty will be 19.5 percent ad valorem. The applicable subheading for the sling tote bag will be 4202.92.3030, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports and similar bags, with outer surface of textile materials, other, other, of man-made fibers, other. The duty rate will also be 19.5 percent ad valorem.

Items 4202.22.8050 and 4202.92.3030 fall within textile category designation 670. Based upon international textile trade agreements, products of Hong Kong and China are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). The samples are being returned to you herewith in accordance with your request.

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
