RE: The tariff classification of ceiling fans with heaters from Taiwan

Dear Mr. Montgomery:

In your letter dated July 31, 1996, on behalf of Pelonis USA, Ltd., you requested a tariff classification ruling.

The merchandise is a ceiling fan. This fan is a composite machine, equipped with a light kit which contains a ceramic electric heater. The importer intends to import a complete unit consisting of a ceiling fan, light and heater, the heater-light component separately, or the heater separately.

The design allows the fan to distribute heat from the ceramic heater at 360 degrees from the center of the room. The heater also contains a built-in fan. The fan, heater and lights may be operated separately. We are of the opinion that, under each of the conditions of importation you have specified, the items would be classifiable as a heater.

The applicable subheading for the complete fan with light and heater, the heater light kit, or the heater will be 8516.29.0090, Harmonized Tariff Schedule of the United States (HTS), which provides for electric space heating apparatus, other, other. The rate of duty will be 3.7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
