RE: The tariff classification of toys and a puzzle from Taiwan, Singapore and Korea

Dear Mr. Diran:

In your letter dated July 24, 1996 you requested a tariff classification ruling on behalf of your client Klutz Incorporated.

Three samples were submitted with your inquiry and are being returned as requested. The first item consists of a small sized version of an "Etch-A-Sketch" toy with a variety of stick-on screens and an instruction book. The stick-on plastic pieces provide expanded use of the original "Etch-A-Sketch" product which creates pictures by turning two knobs located below the screen. In order to erase the picture and begin again one must shake the article to clear the screen. The stick-ons are printed with mazes, puzzles and games which fit over the "Etch-A-Sketch" screen for play. These printed plastic pages may be removed and played with repeatedly as no mark is left on them during use. An instruction book provides ideas on the kinds of pictures one can create and on how to use the stick-on screens. The essential character of this product is imparted by the toy "Etch-A-Sketch".

The "Friendship Bracelets" is composed of a spiral bound book, multi colored embroidery floss, beads and a plastic clip. The book provides instructions for a child to make bracelets in a variety of styles using the thread and beads included with the set. As the item is imported packaged together for retail sale and the components work collectively toward one specific goal, that of teaching a child the basics of bracelet making, the article is considered a toy craft set.

The "Puzzle Arcade" includes a spiral bound book with assorted components attached such as beads, sticks, shapes, a foam puzzle and more. The attached items are required to perform specific puzzles outlined within the text. Puzzles of all kinds are considered toys designed for amusement purposes in Chapter 95.

The applicable subheading for the "Etch-A-Sketch" will be 9503.90.0030, Harmonized Tariff Schedule of the United States (HTS), which provides for other toys (except models), not having a spring mechanism. The rate of duty will be free.

The applicable subheading for the "Friendship Bracelet" will be 9503.70.0030, Harmonized Tariff Schedule of the United States (HTS), which provides for other toys, put up in sets or outfits, and parts and accessories thereof: other: other. The rate of duty will be free.

The applicable subheading for the "Puzzle Arcade" will be 9503.60.2000, Harmonized Tariff Schedule of the United States (HTS), which provides for other toys: puzzles and parts and accessories thereof: other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
