RE: The tariff classification of apparel from Indonesia

Dear Ms. Price:

In your letter dated July 16, 1996, you requested a tariff classification ruling on behalf of The Bob Barker Company. The samples will be returned as requested.

Three items and their specifications were submitted. All of the items are made from 65% polyester/35% cotton woven fabric and you advise that they are unisex. The pull-on pants have a fully elasticized waist and hemmed legs. The jumpsuit has a partial front opening with snap closure, a collar, short sleeves, a breast pocket on the left, and the waist is elasticized in the back. The sleeves and legs are hemmed. The pullover shirt has a V-neck, short raglan sleeves and a breast pocket. The neck opening is capped with self fabric and the sleeves and bottom are hemmed. The garment reaches the waist.

The applicable subheading for the pants will be 6204.63.3510, Harmonized Tariff Schedule of the United States (HTS), which provides for trousers, bib and brace overalls, breeches and shorts: of synthetic fibers: other: other: other: trousers and breeches: women's. The rate of duty will be 30 percent ad valorem. The applicable subheading for the jumpsuit will be 6211.43.0010, HTS, which provides for track suits, ski-suits and swimwear; other garments: other garments, women's or girls' of man-made fibers: coveralls, jumpsuits and similar apparel: other: women's. The rate of duty will be 16.8 percent ad valorem. The applicable subheading for the shirt will be 6211.43.0060. HTS, which provides for ...other garments, women's or girls': of man-made fibers: blouses, shirts and shirt-blouses, sleeveless tank styles and similar upper body garments, excluded from heading 6206. The rate of duty will be 16.8 percent ad valorem.

The pants fall within textile category designation 648; the jumpsuit is category 659; and the shirt is category 641. Based upon international textile trade agreements, products of Indonesia are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.

It is noted that the labels in the sample garments bear the name and address of the U. S. company on the front and the country of origin on the back. 19 CFR 134.46 directs that the when the name of any city or locality in the United States appears on an imported article or its container, there shall appear, legibly and permanently, in close proximity to such words, letters or name, and in at least a comparable size, the name of the country of origin preceded by "Made in," "Product of," or other words of similar meaning.
