RE: The tariff classification of Antioxidant Songnox 1010 and Antioxidant Songnox 1076 (CAS # 2082-79-3) from South Korea

Dear Ms. Sugar:

In your letter dated July 5, 1996, you requested a tariff classification ruling on behalf of your client Grenhall Chemicals Limited.

The applicable subheading for Antioxidant Songnox 1010 also known as Pentaerythrityl tetrakis (3,5-di-t-butyl-4-hydroxybenzene propanoate) will be 2918.29.6500, Harmonized Tariff Schedule of the United States (HTS), which provides for carboxylic acids with phenol function but without other oxygen function, their anhydrides, halides, peroxides, peroxyacids and their derivatives: other: other: products described in additional U.S. note 3 to section VI. The rate of duty will be 12.1 percent ad valorem.

The applicable subheading for Antioxidant Songnox 1076 also known as Octadecyl 3,5-bis (1,1-dimethylethyl)-4-hydroxybenzene-propanoate will be 2918.29.7500, Harmonized Tariff Schedule of the United States (HTS), which provides for carboxylic acids with phenol function but without other oxygen function, their anhydrides, halides, peroxides, peroxyacids and their derivatives: other: other: other. The rate of duty will be 3 cents per kilogram plus 15.6 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
