RE: The tariff classification of various threaded and non-threaded fasteners from Great Britain.

Dear Ms. Spivey:

In your letter dated June 24, 1996, you requested a tariff classification ruling on behalf of you client, IRC, International Resistive Company, Boone, N.C. Illustrative literature and samples were provided with the request and additional information was provided by telephone.

There are four different types of steel fasteners under review. They are described as "studs, threaded and non-threaded nuts, and pins" all of which are designed for permanent installation by having sheet metal partially crimped around them. The fastener described as a stud is threaded on one end while the other end has a short, hat shaped head with external ridges running parallel to the axis of the fastener. Some of the studs depending upon their intended usage will have a shoulder at the junction of the threads and the head. During installation, a special tool is used that permanently crimps sheet metal around the head of the fastener leaving a threaded protuberance.

The fasteners described as threaded and non-threaded nuts are hat-shaped with external ridges running parallel to the axis of the fastener. Both fasteners are tubular with the example identified as a threaded nut being internally threaded, while the hole through the non-threaded nut is smooth. During installation, a special tool is used that permanently crimps sheet metal around the fasteners. Per the additional information, the non-threaded nut is intended to be used with self-tapping or thread cutting screws which will create their own threads during their installation.

The item described as a pin, is similar to the item described as a stud except that it is non-threaded. Per information provided, the crimping operation leaves a protruding pin to be used as a locating pin during further assembly operations.

The applicable subheading for the stud will be 7318.15.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for "Screws, bolts, nuts...and similar articles, of iron or steel: Threaded articles: Studs...". The rate of duty will be 2.8% ad valorem.

The applicable subheading for the threaded nut will be 7318.16.0080, HTS, which provides for "Screws, bolts, nuts...and similar articles, of iron or steel: Threaded articles: Nuts...Other". The rate of duty will be 0.1% ad valorem.

The applicable subheading for the non-threaded nut and the pin will be 7318.29.0000, HTS, which provides for "Screws, bolts, nuts...and similar articles, of iron or steel: Non-threaded articles: Other:". The rate of duty will be 4.5% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
