RE: The tariff classification of a cotton, non-woven vest and decorative stocking from China.

Dear Mr. Shafaii:

In your letter dated March 29, 1996, received in our office April 1, 1996 you requested a classification ruling. Samples were submitted for examination with your request.

The submitted samples are a unfinished vest and a decorative stocking consisting of 100% cotton non-woven needle point felt. The styles that will be imported are 0401-01/02, small stockings 8" X 11", 0401-03/04 large stockings 11"X 18", 0401-05/06 Medium Vest and 0401-07/08 X-Large Vest. You state the vests are designed for women. The vest has a full front opening with no closures. The outer edges of the vest and decorative stocking have been stitched to prevent fraying. The stocking is designed to be used for decorative purposes and is not considered hosiery. These items will be marketed through crafts retailers and they appear to be designed for use as a base for decorating, etc.

The applicable subheading for the vest will be 6210.10.9040, Harmonized Tariff Schedule of the United States (HTS), which provides for garments, made up of fabrics of heading 5602, 5603, 5903, 5906 or 5907: Of fabrics of heading 5602 or 5603: Other: Other: Other.... Other. The duty rate will be 16.8 percent ad valorem.

The applicable subheading for the decorative stocking will be 6307.90.9989, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles, including dress patterns: Other: Other: Other. The duty rate will be 7 percent ad valorem.

The vest falls within textile category designation 659. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
