RE: The tariff classification of a girl's skirt and top from China.

Dear Mr. Imbrogulio:

In your letter, received in our office on February 7, 1996, on behalf of your client S.C.B. Apparel, Inc., you requested a tariff classification ruling.

Style S/600 is a 55% ramie, 45% cotton black mesh knit top. The top features tube type construction, with elasticized fabric at both the top and bottom of the tube band. The item also has self fabric straps which button onto the garment front.

Style S/601 is a 55% ramie, 45% cotton black mesh knit skirt. The skirt features an elasticized knit waist.

Your letter did not indicate the size(s) for which the top and skirt will be imported. For purposes of classification, we will assume that the garments will be imported in girls' sizes 4-6X.

The applicable subheading for the skirt, Style S/601, will be 6104.59.8090, Harmonized Tariff Schedule of the United States (HTS), which provides for women's or girls' skirts and divided skirts; of other textile materials, other, other. The rate of duty will be 5.9% ad valorem.

The skirt falls within textile category designation 842. Based upon textile trade agreements, products of China are presently subject to quota restraints and visa requirements.

The applicable subheading for the top, Style S/600, will be 6114.90.9010, Harmonized Tariff Schedule of the United States (HTS), which provides for other garments, knitted or crocheted, of other textile materials, other, tops. The rate of duty will be 5.9% ad valorem.

The top falls within textile category designation 838. Based upon textile trade agreements, products of China are presently subject to quota restraints and visa requirements.

The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
