RE: The tariff classification of a partially embroidered needlepoint tapestry from Hong Kong.

Dear Mr. Kent:

In your letter dated January 28, 1994, you requested a classification ruling.

You have submitted a sample of an unfinished needlepoint tapestry, style name Trame',article number 3732. The rectangular hemmed canvas measures 23 by 20 inches, and the design portion measures 17 by 13 inches. The item consists of a woven cotton canvas which has been partially or semi-embroidered with plied 100% wool yarn. These yarns do not completely cover the canvas ground. To complete the tapestry, the customer matches the embroidered long stitches, which mark out a landscape picture, with the correct color from a separate package of wool yarns. One side of the canvas material is a selvage, while the other three sides have been folded over twice, pressed and hemmed. After the customer completes the stitch work, the needlepoint can be framed and hung. The four-ply worsted 100% wool yarns used to complete the tapestry will be also be imported in a separate package together with the tapestry. Samples of these yarns were not submitted with your request. The unfinished tapestry will imported and sold in rolled up form but will not be put up for retail sale.

The applicable subheading for the Trame' needlepoint will be 5810.91.0020, Harmonized Tariff Schedule of the United States (HTS), which provides for embroidery in the piece, in strips or in motifs; other embroidery; of cotton; other. The duty rate will be 8.4 percent ad valorem.

Your inquiry does not provide enough information for us to give a classification ruling on the wool yarns used to complete the needlepoint. Your request for a classification ruling should include a sample of the yarn package.

The embroidered cotton fabric falls within textile category designation 229. Based upon international textile trade agreements, products of Hong Kong are subject to the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
