RE: The tariff classification of women's woven wearing apparel from China

Dear Ms. Rice:

In your letter dated January 12, 1994, you requested a tariff classification ruling.

Style 34682/34683 consists of two pieces manufactured from woven fabric that is 100 percent linen. The blouse features long sleeves with button cuffs, a collar, lapels, padded shoulders, four inch side slits and a full front opening secured by five buttons. The garment also has embroidered cutouts on the collar, cuffs and around the bottom. The pants have an elasticized waistband and straight legs that extend to the ankle.

Style 0261/0284 consists of two pieces manufactured from woven fabric that is 100 percent rayon crepe. The vest features a V-neckline and a full front opening secured by a side tie front closure and an inside tie closure. The pants are as described above.

Style 0902/0904 is a suit manufactured from woven fabric that is 87 percent rayon/13 percent wool. The fully lined jacket features padded shoulders, two chest pockets with flaps, long sleeves with three buttons near the sleeve edge, 5 1/2 inch side slits and a full front opening secured by five buttons. The pants are as described above but with a full lining.

The applicable subheading for the blouse of style 34682/34683 will be 6206.90.0040, Harmonized Tariff Schedule of the United

States (HTS), which provides for women's or girls'; blouses, shirts and shirt-blouses: of other textile materials...other. The rate of duty will be 7.1 percent ad valorem.

The applicable subheading for the pants of style 34682/34683 will be 6204.69.9044, Harmonized Tariff Schedule of the United States (HTS), which provides for women's or girls' suits, ensembles, suit-type jackets, blazers, dresses, skirts and divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): trousers, bib and brace overalls, breeches and shorts: of other textile materials: other: other: trousers and breeches. The rate of duty will be 7.5 percent.

The applicable subheading for the vest of style 0261/0284 will be 6211.43.0076, Harmonized Tariff Schedule of the United States (HTS), which provides for track suits, ski-suits and swimwear: other garments: other garments, women's or girls': of man-made fibers... vests: other. The rate of duty will be 17 percent ad valorem.

The applicable subheading for the pants of style 0261/0284 will be 6204.69.2510, Harmonized Tariff Schedule of the United States (HTS), which provides for women's or girls' suits, ensembles, suit-type jackets, blazers, dresses, skirts and divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): of other textile materials: of artificial fibers: trousers, breeches and shorts: other... trousers and breeches: women's. The rate of duty will be 30.4 percent ad valorem.

The applicable subheading for style 0902/0904 will be 6204.19.2000, Harmonized Tariff Schedule of the United States (HTS), which provides for women's or girls' suits, ensembles, suit-type jackets, blazers, dresses, skirts and divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): suits: of other textile materials: of artificial fibers: other. The rate of duty will be 37.5 cents/kg + 27.5 percent ad valorem.

The blouse of style 34682/34683 falls within textile category designation 840 and the pants fall within category 847. The vest of style 0261/0284 falls within textile category 659 and the pants fall within category 648. Style 0902/0904 falls within textile category 644. Based upon international textile trade agreements, products of China are subject to a visa requirement and quota restraints.

The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
