RE: The tariff classification of an equipment bag from Haiti.

Dear Ms Tomar:

In your letter dated September 13, 1993, you requested a tariff classification ruling for two items identified as numbers 1 and 2.

The submitted sample, identified as item 1, is a vinyl equipment bag designed to contain personal effects as well as for sports and recreational use. It measures approximately 35" x 12" with 7 1/2" gussets. The bag has double webbed textile carrying handles, in addition to a removable adjustable textile shoulder strap. The item is secured by means of a top heavy duty zipper closure.

The applicable subheading for Item 1, the equipment bag of vinyl will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports and similar bags, with outer surface of sheeting of plastic, other. The duty rate will be 20 percent ad valorem.

Your inquiry does not provide enough information for us to give a classification ruling on item #2. Your request for a classification ruling should include an actual sample as being imported and a material breakdown by weight of what the item is made of.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

Merchandise, which is the product of Haiti, may be subject to import and export sanctions as provided by the Haitian Trade Embargo. It is recommended that you verify the latest status with:
