RE: The tariff classification of an automatic nail polish remover from Johannesburg, South Africa.

Dear Mr. McCormack:

In your letter dated January 21, 1991, you requested a classification ruling.

The sample you submitted is a portable battery operated, automatic nail polish remover called Perfect 10. The item consists of a self con tained battery operated unit that has a sealing cap which covers a cleaning sponge. After a small amount of polish remover is poured onto the sponge, the user switches the unit on, inserts one finger at a time into the hole located in the centre of the sponge, allowing the sponge to rotate 2 or 3 times. This rotating action in conjunction with the polish remover will remove the polish from the nails.

The applicable subheading for the automatic nail polish remover will be 8509.80.0090, Harmonized Tariff Schedule of the United States (HTS), which provides for Electromechanical domestic appliances, with self- contained electric motor, Other. The duty rate will be 4.2%.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
