RE: The tariff classification of file attachment for pocket knife from Switzerland.

Dear Mr. Tooze:

In your letter dated August 17, 1990, on behalf of Leatherman Tool Group, Inc., you requested a tariff classification ruling.

The sample submitted is a file blade measuring approximately 6 1/2 centimeters, excluding the tang section which has a hole and a locking notch. The file is to be incorporated into a pocket knife with multiple attachments.

A smooth file blank is sent to Switzerland where the file teeth are cut on both sides. We consider this manufacturing process to be a substantial transformation of the article into a product of Switzerland.

The applicable subheading for the file blade will be 8203.10.3000, Harmonized Tariff Schedule of the United States (HTS), which provides for files, rasps and similar tools not over eleven centimeters in length. The rate of duty will be 9 cents per dozen.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
