RE: The tariff classification of various products used to control the operation of Flash Point Detectors from Japan.

Dear Mr. Christie:

This classification decision under the Harmonized Tariff Schedule of the United States (HTS) is being issued in accordance with the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

DATE OF INQUIRY : May 11, 1990.

DESCRIPTION OF
MERCHANDISE : The various products used exclusively to control the operation of a Flash Point Detector include the following:

1. Item 316017, Panel Board;
2. Item 316014, Relay Board comprised of 4 to 6 relays on a common board; 3. Item 316023, Signal Cable with connectors (less than 15VDC); 4. Item 316025, Power Cable (copper) with connectors (120 VAC); 5. Item 316009, 316030, 316031 and 316032 glass bodied fuses; 6. Item 316005 and 316006, Photo Sensors; 7. Item 316043 and 316044, Wire Form Flash Detectors. HTS PROVISION : Boards, equipped with two or more apparatus of heading 8536, for electric control or the distribution of electricity: For a voltage not exceeding 1,000 V... Other: for the Panel Board and the Relay Board.

RATE OF DUTY : 5.3 percent ad valorem.

HTS PROVISION : Insulated cable, whether or not fitted with connectors: Other electric conductors, for a voltage not exceeding 80V: Fitted with connectors...for the Signal Cables.

HTS SUBHEADING : 8544.41.0000

RATE OF DUTY : 5.3 percent ad valorem.

HTS PROVISION : Insulated cable, whether or not fitted with connectors: Other electric conductors, for a voltage exceeding 80V but not exceeding 1,000V: Fitted with connectors: Other... for the Power Cable.

HTS SUBHEADING : 8544.51.8000

RATE OF DUTY : 5.3 percent ad valorem.

HTS PROVISION : Fuses, for a voltage not exceeding 1,000V: Fuses... Glass Cartridge... for the fuses.

HTS SUBHEADING : 8536.10.0020

RATE OF DUTY : 5.3 percent ad valorem.

HTS PROVISION : Other diodes... Other... for the Photo Sensors

HTS SUBHEADING : 8541.40.6050

RATE OF DUTY : free of duty

HTS PROVISION : Parts and accessories: Of electrical instruments and apparatus for physical or chemical analysis... for the Wire Form Flash Detectors.

HTS SUBHEADING : 9027.90.4000

RATE OF DUTY : 4.9 percent ad valorem.

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
